The Timmins Police is issuing a Traffic Advisory in light of a number of “close calls” that persist in occurring at the intersection of Hwy 101 and Kamiskotia Road in the west end of the city.

Based on complaints received, it appears that drivers who are approaching the intersection from either direction while on Hwy 101 are electing to overtake traffic slowing to turn left by passing these vehicles on the right by using the right turn lanes that exist to facilitate right turns.

These right turn lanes at this intersection, as their name would clearly indicate, are in place expressly to allow for traffic to complete:

– a right turn onto Kamiskotia Road if approaching from the east or

-a right turn onto Government Road if approaching from the west.

These lanes are not to be used to facilitate the overtaking of traffic on the right.

Additionally, in certain cases, drivers have opted to leave the roadway to complete the passing of stopped traffic on the right.

This practice is in direct contravention of section 150(2) of the Highway Traffic Act as outlined below

Section 150(2) No driver of a motor vehicle shall overtake and pass another vehicle by driving off the roadway.  

This intersection and its intended safe usage will be scrutinized by the Timmins Police Service in the course of their patrols to enhance roadway safety in this area.

Those motorists found to be in violation will have their driving behavior addressed in a firm but fair manner by the Timmins Police.
