The Timmins Police Service has charged a local person with Impaired Driving related Criminal Code offences stemming from 2 separate incidents that occurred in late December of 2022, and again in February of 2023.
A Timmins Police Service officer observed a vehicle being driven in an erratic fashion during the early morning hours of Sunday February 19th on Mountjoy Street South.
A traffic stop was initiated by the Timmins Police officer where it was noted that the driver struck a snow bank as it came to rest in a driveway.
Based on the observations made by the officer, the driver of the vehicle was arrested and taken to the Timmins Police station to complete further breath testing procedures.
As a result of the incident, Emma BRABANT, 27, of Timmins, has been charged with:
– Impaired Operation of a Motor Vehicle contrary to the Criminal Code of Canada
– Operate Motor Vehicle – Concentration in Excess of 80 mgs of Alcohol per 100 mls of Blood contrary to the Criminal Code of Canada
– Drive Under Suspension contrary to the Highway Traffic Act
The accused was released from police custody on the strength of an Undertaking compelling her to attend at the Ontario Court of Justice in Timmins on March 7th to address the charges laid against her.
In a previous incident, a Timmins Police Service officer, responding to a traffic complaint called in by a concerned citizen during the morning hours of Friday, December 30th (2022), located the subject vehicle being operated in an erratic manner.
A traffic stop was initiated by the Timmins Police officer on Second Avenue and the driver was interviewed.
Based on observations made by the officer, the driver of the vehicle was arrested and taken to the Timmins Police station to complete breath testing procedures.
A quantity of a cannabis and an unsealed container of wine were located within ready reach of the driver.
As a result of this incident, the same accused was charged with:
– Impaired Operation of a Motor Vehicle contrary to the Criminal Code of Canada – Refuse or Fail to Comply with a Breath Demand contrary to the Criminal Code of Canada
The accused was released from police custody on the strength of an Undertaking compelling him to attend at the Ontario Court of Justice in Timmins to address these charges laid against her.
